Diez años desde la entrada en vigor de la Ley Orgánica 5/2000, de 12 de enero, de la Responsabilidad Penal de los Menores han servido para mucho. Desde que se optó por legislar los ilícitos penales cometidos por aquellos menores con edades comprendidas entre los 14 y los 18 años, muchas y variadas son las certezas e incertidumbres que, al respecto de un tema tan complejo y tortuoso, han visto la luz en nuestro entramado social.

Neste artigo nos apoiamos em testemunhos diversos de Francis Bacon a respeito da relação entre sua filosofia e o ceticismo filosófico para estender o exame desse ponto ao âmbito de sua ?Doutrina dos Ídolos?. Pretendemos mostrar que, se por um lado as semelhanças revelam-se aí significativas , pode-se também observar, de outra parte, que já nessa Doutrina Bacon prepara uma via diversa da que atribui aos céticos, tanto em vista do modo como compreende a noção de natureza humana, como do (...) encadeamento metódico a que ele submete o material que toma dos céticos. The body of Eva in Thomas Aquinas The constitution of the first female body or the body of Eva presents several physical and metaphysical problems, problems that have gone through the centuries and reach the present, generating social and cultural consequences for women. The non-existence of parents demands from Aquino answers that go beyond the anthropological and biological and lead to the search of philosophical answers intertwined with the theological ones. Thomas Aquinas provides rational answers although the background is of (...) faith, and even, with literal interpretations of the Sacred Scriptures now abandoned. The Aquinate makes an intellectual effort to find answers in a rational field because the matter of the body of the first woman brings difficulties for its elucidation and understanding. As in other parts of his extensive work, Thomas Aquinas, follows the biological and physical works of Aristotle. Although the Aristotelian background is in line with Christian thought, Aquinas shows his extraordinary capacity for synthesis between the faith received and reason argued, between revelation and the principles of reason. La Suma Teológica de Santo Tomás permite categorizar términos tecnológicos y establecer ontologías en clave filosófica. Con esta metodología de la Suma se va a estudiar aquí el término “metaverso” y sus implicaciones éticas. El artículo aporta además una revisión sistemática de literatura científica para elaborar un mapa de conocimiento desde un punto de vista cualitativo y cuantitativo que visibilice el impacto de (...) esta terminología emergente en la investigación. There is considerable support for the idea that an atmosphere of safety can foster learning in groups, especially during ethics training courses. However, the question how safety dynamics works during ethics courses is still understudied. This article aims to investigate safety dynamics by examining a critical incident during a military ethics train-the trainer course during which safety was threatened. We examine this incident by means of a four-factor analysis model from the field of Theme-Centered Interaction (TCI). We show that during (...) ethics training courses a safety paradox can occur, involving a tension between honesty and openness to other perspectives and values. There is increasing interest in determining what impact having women in management positions may have on corporate social responsibility initiatives. Various authors suggest that gender equality practices should be factored into the broader framework of CSR. This paper examines how the presence of women on corporate boards, in top and middle management and as heads of CSR departments, influences gender equality practices in the field of CSR. Using information collected from companies that have signed up to Women's Empowerment Principles in (...) Spain, we show that the presence of women in the aforesaid posts has a positive impact on CSR activities with gender equality objectives. We thus supplement the justice, business and moral arguments with further arguments in support of the incorporation of women into not only corporate boards but all management positions. Finally, we provide a view of how gender equality can be included in the broader framework of CSR. (shrink)

Architecture and human-built structures are embedded with speciesist practices of domination over the environment, where humans are considered special and superior to other species. This (hu)man exceptionalism has driven architecture and the built environment to be conceived in opposition to ‘nature’, dominating natural terrains and consequently displacing or instrumentalizing the many other species that are given little to no ethical consideration. This way of intervening in the world is leading to the existential questions that must be posed given our global (...) climate crisis. A reframing of human intervention as ‘built environment’ placed in opposition to the ‘natural environment’ of supposedly passive nature, is urgently needed. The motivation for this paper is rooted in a deep concern for the role of humans in the climate crisis and a realization that architecture as a discipline is complicit in elevating the human category above all other beings in nature. There are biases embedded in the practices and teaching of architecture that need to be interrogated and reflected upon, starting with the role models and ideals that we unwittingly operate within. To contextualize the idea of human exceptionalism in architecture, we will explore deep-seeded ideals in architecture linked to the concept of Rectitude as a form of ‘rightness’ -or correct- mode of intervening in the world, conceptualized by Western men as a human-centric practice distinct from nature-made. Supported by Ecofeminist thought, the aim is to open alternative models for world-building and housing humans on earth living in its sixth extinction. (shrink)

Biobanks are important resources for improving public health and individual care. Some legal frameworks can be more or less conducive to advancing the potential benefits of biobanks. The purpose of this article is to assess biobanking legislation and practices in Spain to determine how well they fare in such a regard. We focus here on some of the primary ethical values that ground relevant legislation and that we believe are consistent with promoting biobanking benefits: the value of scientific research; efficient (...) use of scarce resources; and respect for the dignity of donors. We argue that although Spanish regulations advance these values in important ways, they also have provisions that undermine them and thus risk limiting the potential benefits of biobanks. This study focuses on the application of multicriteria decision-making techniques, specifically the analytic hierarchy process (AHP), to identify corporate socialresponsibility information which both companies and stakeholders consider relevant and material. This work explains how the AHP methodology was applied in the selection of material indicators in corporate social responsibility reporting, the interpretation of these indicators and their relative importance. The results of this study are summarized in 60 indicators distributed in four areas: environment, economy, corporate governance and social. Este artículo pretende realizar un repaso por la historiografía de la noción de averroísmo latino, desde los primeros trabajos de E. Renan hasta las investigaciones más recientes. Se destaca la falta de acuerdo entre las distintas posiciones y las grandes dificultades de definición que ésta categoría ha comportado para los historiadores de la filosofía durante los dos últimos siglos.

On 11 September 2019, the verdict was read in the first prosecution of a doctor for euthanasia since the Termination of Life on Request and Assisted Suicide (Review Procedures) Act of 2002 was installed in the Netherlands. The case concerned euthanasia on the basis of an advance euthanasia directive (AED) for a patient with severe dementia. In this paper we describe the review process for euthanasia cases in the Netherlands. Then we describe the case in detail, the judgement of the (...) Regional Review Committees for Termination of Life on Request and Euthanasia (RTE) and the judgement of the medical disciplinary court. Both the review committees and the disciplinary court came to the conclusion there were concerns with this case, which mainly hinged on the wording of the AED. They also addressed the lack of communication with the patient, the absence of oral confirmation of the wish to die and the fact that the euthanasia was performed without the patient being aware of this. However, the doctor was acquitted by the criminal court as the court found she had in fact met all due care criteria laid down in the act. We then describe what this judgement means for euthanasia in the Netherlands. It clarifies the power and reach of AEDs, it allows taking conversations with physicians and the testimony of the family into account when interpreting the AED. However, as a practical consequence the prosecution of this physician has led to fear among doctors about prosecution after euthanasia. (shrink)

Slightly modified excerpt from the section 13.4 Zusammenfassung und Ausblick (translated into englisch): This chapter is based on an analysis of ethical debates on epigenetics and genome editing, debates, in which ethical arguments relating to future generations and justice play a central role. The analysis aims to contextualize new developments in genetic engineering, such as genome and epigenome editing, ethically. At the beginning, the assumptions of "genetic determinism," on which "genetic essentialism" is based, of "epigenetic determinism" as well as "genetic" (...) and "epigenetic exceptionalism" are analyzed and critically discussed. The remarks on the ethical discourse on epigenetics show that the notion of "epigenetic determinism" can sometimes be discerned not only in popular scientific discourse but also in ethical discourse. Ethical debates on epigenetics, however, have distanced themselves from this deterministic understanding. As a result, the focus in the ethical discourse on epigenetics shifts from responsibility for one's own health and that of subsequent generations to justice. What is meant here is justice, for example, in terms of access to healthy environmental conditions, regardless of whether these contribute to health with or without epigenetic agency. An analysis of the discourse on genome editing reveals that it is primarily germline interventions that are being ethically examined, with a concentration on the aspect of inheritance. The question is whether this is accompanied by an implicit "genetic determinism" or even a "genetic essentialism": the determinism could lie in the centrality of the aspect of heritability, since only genetic information is inherited. Does the aspect of heritability and genome modification play a more decisive role in debates on genome editing than the safety issue? Is the problem of embryos and their potential offspring not being able to consent to germline intervention given such a high priority because it is a genetic intervention? Under such a premise of "strong genetic determinism" supplemented by "epigenetic determinism," not only genome editing but also epigenome editing would be ethically relevant precisely because it too would have an influence on the genome. How this influence of genome editing and epigenome editing is ethically evaluated in each case therefore depends initially on whether the assumptions of "genetic" and "epigenetic determinism" are advocated. These assumptions are increasingly viewed critically in ethical discourse because they cannot be confirmed from a scientific perspective. In popular scientific debates in particular, however, they seem to persist, which ultimately also influences the public discussion. La expresión veritas vitae o “verdad de la vida” significa, en Tomás de Aquino, que el hombre realiza en su vida los designios existentes sobre él en la mente de Dios. El estudio de los textos aquinianos pone de manifiesto que el sintagma veritas vitae forma parte de la “triple verdad” y se sitúa a un nivel más profundo que la virtud de la veracidad. La relación entre veracidad y “verdad de la vida” abre una perspectiva interesante que puede prestarse (...) al diálogo con los filósofos contemporáneos sobre el tema de la autenticidad.The expression veritas vitae or “truth of life” means, in the writings of Thomas Aquinas, the realization of each person’s life according to the plan of the Creator. A study of the texts shows that the syntagma veritas vitae belongs to the so-called “ three-fold truth” and is of a deeper kind than the virtue of truthfulness. For contemporary philosophers, the relationship between truthfulness and “truth of life” opens up an avenue for dialogue regarding the topic of authenticity. (shrink)

In this work three recent proposal of analysis of the concept of ‘religion’ are discussed. There is a strong convergence between these three proposals in several points: all of them maintain that a religion should be the belief of something –a set of propositions, the object of a propositional attitude like a belief–, all of them maintain that the object of the belief should be a theory about the good, and all of them maintain that a religion should have important (...) normative and practical consequences. It is argued here that there are at least two problems with the general conception that results from these analyses. In the first place, attributing to a religion the conditions of identity of an act of belief leads to absurd consequences. In the second place, it seems much better to analyze a religion as a theory about God or some gods. (shrink)

With the increasing adoption of artificial intelligence (AI) technologies in the news industry, media organizations have begun publishing guidelines that aim to promote the responsible, ethical, and unbiased implementation of AI-based technologies. These guidelines are expected to serve journalists and media workers by establishing best practices and a framework that helps them navigate ever-evolving AI tools. Drawing on institutional theory and digital inequality concepts, this study analyzes 37 AI guidelines for media purposes in 17 countries. Our analysis reveals key thematic (...) areas, such as transparency, accountability, fairness, privacy, and the preservation of journalistic values. Results highlight shared principles and best practices that emerge from these guidelines, including the importance of human oversight, explainability of AI systems, disclosure of automated content, and protection of user data. However, the geographical distribution of these guidelines, highlighting the dominance of Western nations, particularly North America and Europe, can further ongoing concerns about power asymmetries in AI adoption and consequently isomorphism outside these regions. Our results may serve as a resource for news organizations, policymakers, and stakeholders looking to navigate the complex AI development toward creating a more inclusive and equitable digital future for the media industry worldwide. RESUMEN Trabajos recientes han propuesto un tratamiento de la fundación “a la imagen de la causalidad”. Hay importantes analogías entre la fundación y la causalidad: ambas parecen ser relaciones de ‘construcción’, ambas parecen ser órdenes estrictos y ambas parecen ser representables por modelos de ecuaciones estructurales. Pero también parece que hay importantes diferencias, porque la causalidad es usualmente considerada como una relación externa, mientras que la fundación es interna; hay casos de causalidad probabilística, pero no hay nada como una fundación (...) probabilística; la fundación se considera una relación ‘bien fundada’, pero no la causalidad; la fundación implica superveniencia ontológica, pero no la causalidad. Se argumenta aquí que la mayoría de estas supuestas diferencias están motivadas por una concepción humeana de la causalidad en la que no hay conexiones necesarias entre causa y efecto. Una perspectiva no humeana de la causalidad, sin embargo, hace que la unificación de la fundación y la causalidad sea mucho más razonable que cualquier tratamiento separado. ABSTRACT Recent works have proposed a treatment of grounding “in the image of causation”. There are important analogies between grounding and causation: both seem to be ‘building’ relations, both seem to be strict orders, and both seem amenable to representation by models of structural equations. But it seems also that there are important differences, because causation is usually considered as an external relation, while grounding is internal; there are cases of probabilistic causation, but there is nothing like probabilistic grounding; grounding is taken to be a well-founded relation, but not causation; grounding entails ontological supervenience, but not causation. It is argued here that most of those supposed differences are motivated by a Humean conception of causation in which there are no necessary connections between cause and effect. A non-Humean view of causation, though, makes the unification of grounding and causation much more reasonable that any separate treatment. (shrink)

From past research it is well known that social exclusion has detrimental consequences for mental health. To deal with these adverse effects, socially excluded individuals frequently turn to other humans for emotional support. While chatbots can elicit social and emotional responses on the part of the human interlocutor, their effectiveness in the context of social exclusion has not been investigated. In the present study, we examined whether an empathic chatbot can serve as a buffer against the adverse effects of social (...) ostracism. After experiencing exclusion on social media, participants were randomly assigned to either talk with an empathetic chatbot about it (e.g., “I'm sorry that this happened to you”) or a control condition where their responses were merely acknowledged (e.g., “Thank you for your feedback”). Replicating previous research, results revealed that experiences of social exclusion dampened the mood of participants. Interacting with an empathetic chatbot, however, appeared to have a mitigating impact. In particular, participants in the chatbot intervention condition reported higher mood than those in the control condition. Theoretical, methodological, and practical implications, as well as directions for future research are discussed. (shrink)

It has been lately proposed that laws of nature are causal powers. The conditions of identity of universals are the causal powers that those universals give to their instantiations. One of the main objections against this conception of laws of nature and universals is that it would lead to, either an infinite regress, or a vicious circularity. In effect, if the conditions of identity of a universal are the causal powers that the universal gives to its instantiations, then it seems (...) that the conditions of identity of a universal depend on other universals, because a causal power is the power to produce the instantiation of some universal or other. In this work it is considered if this problem can be tackled by a relaxation of some of the formal characteristics of ontological dependence, but this strategy appears inconvenient. Another more promising alternative is to suppose that universals are ontologically dependent on the network of nomological relations to which they belong. Under certain formal assumptions about the graph-theoretical structure of the nomic network the identity of a universal can be grounded by its sole position in it. The conception here defended results a form of nomic holism. (shrink)
